TDLR rules · 16 TAC Chapter 85; Occ. Code §2303.154(f)

Records retention

Two years, with proof of mailing for every letter. What a clean file looks like on inspection day.

The rule

Keep VSF records for two years. TDLR's enforcement statistics list "Failed to maintain required records for 2 years" as a cited violation.

For title purposes, proof of delivery is not required if proof of mailing is provided (Occ. Code §2303.154(f)). Keep the postmark proof, not just the green card.

A complete vehicle file: receipt date and time, tow source, two-hour report record (private-property tows), owner and lienholder records and request dates, every notice as mailed with postmark proof, returned envelopes, publication proof, abandonment reports and $10 receipts, invoices, and the disposal or release record.

Worked dates

A car released in March 2026 keeps its full file until at least March 2028.

The common mistake

Keeping notices in the software but tossing returned mail. The unopened envelope is the evidence that publication was not required.

What an inspector asks for

  • Any vehicle file from the last two years, on request
  • Proof of mailing for each notice
  • Two-hour report log
