TDLR rules · Occ. Code §§2303.1545, 2303.157(c); 16 TAC §85.703(h)

Nuisance vehicles

Ten years or older, fit only for demolition. One notice, disposal 30 days after the first notice, plus agency paperwork.

The rule

An abandoned nuisance vehicle is one in a condition only to be demolished, wrecked or dismantled. A vehicle less than 10 years old cannot be a nuisance vehicle.

For a qualifying vehicle the VSF sends only the first notice; no second notice is required.

Disposal is allowed on the 30th day after the first notice is mailed or published (§2303.1545). That is 30 days from the first postmark, not from arrival.

The statute adds an application requirement before the 30th day (§2303.157(c)) and addresses the case where a law-enforcement agency does not take custody. Confirm the current paperwork with the agency and counsel before relying on this path.

Worked dates

A 2009 sedan with no engine, first notice postmarked Friday, March 6, 2026. Day 30 after that postmark is Sunday, April 5. File the required application before then, and document the condition with photos.

The common mistake

Putting a rough 2018 car on the nuisance path. Age disqualifies it no matter the condition. We flag candidates; the owner decides in writing.

What an inspector asks for

  • Model year evidence
  • Photos of condition
  • First notice postmark
  • The application or agency filing and its date
